The speech by the Secretary for Justice at the People to People International Conference on Nov 9, 2000

The Secretary for Justice, Ms Elsie Leung said at the opening ceremony of the People to People International Conference - "The Promise of Asia: Hong Kong - A City in Transition" on November 9, 2000 that all the cornerstones of Hong Kong's way of life remain firmly in place - the rule of law, the protection of human rights, and an independent judiciary. She stressed that the rights and freedoms of the people of Hong Kong are fully protected by the International Covenant on Civil and Political Rights and the Basic Law .

In her speech delivered at the Ceremonial Opening of the Legal Year on 17 January 2000, the Secretary for Justice spoke on the new constitutional order of the HKSAR and the work of the Department of Justice.


The Secretary for Justice's Speech at the Seminar on Comparison between the Legal Systems of the Mainland and Hong Kong

In her speech delivered at the Seminar on Comparison between the Legal Systems of the Mainland and Hong Kong held on 19 November 1999, the Secretary for Justice stressed that the need for better understanding and knowledge of the HKSAR and the Mainland's legal systems, which will be conducive to the successful implementation of "one country, two systems" and the Basic Law.

On the New Constitutional Order and Human Rights in Hong Kong

At the closing ceremony of the 10th Zonta International District 17 Conference on 7 November 1999, the Secretary for Justice delivered a speech on HKSAR's new constitutional order and current human rights condition.

The New Constitutional Order under the Basic Law

The Chinese resumption of exercise of sovereignty over Hong Kong has changed Hong Kong's constitutional order. The Basic Law which came into force on 1 July 1997 superseded the Letters Patent and the Royal Instructions as the supreme constitutional instrument of the HKSAR. In her speech "The New Constitutional Order under the Basic Law" at the Annual Reunion Dinner of St John's College, University of Hong Kong on 1 November 1999, the Secretary for Justice discussed the salient features of our new constitutional order as well as its challenges and prospects.


The Secretary for Justice's Speech at the Annual Gender Role Workshop 1999

At the Annual Gender Role Workshop1999 on 23 October 1999, the Secretary for Justice spoke on the topic of "Protect Myself and My Children: Say No to Sexual Violence". Apart from reviewing current legislation dealing with sexual offences, she also talked about the Prevention of Child Pornography Bill, the Crimes (Amendment) Bill 1999 and the Evidence (Amendment) Bill 1999, which were introduced into the Legislative Council to combat sexual offences.

Symposium for the 10th Anniversary of the Promulgation of the Basic Law

Mr. Ian Wingfield, JP, the Law Officer (Civil Law), delivered a speech at the Symposium for the 10th Anniversary of the Promulgation of the Basic Law on 1 April 2000. He expressed his views on how the concept of "One Country, Two Systems" had been developed and implemented both before and after the reunification.


Solicitor General

Speeches of SJ, Mr Robert Allcock (Solicitor General (Acting)) and Mr Andrew Bruce, SC (Senior Assistant Director of Public Prosecutions) delivered at the "Constitutional Law Conference on Implementation of the Basic Law: A Comparative Perspective"

The Conference was co-organised by the Department of Justice of the HKSAR Government and the Faculty of Law of the University of Hong Kong on 28 and 29 April 2000 to commemorate the 10th anniversary of the promulgation of the Basic Law. With the theme of "Constitutional Interpretation and Constitutional Review", the Conference has provided a forum for constitutional law experts from various jurisdictions to address important constitutional issues, and an opportunity for members of the Hong Kong legal profession and other interested parties to keep abreast of the latest constitutional developments from a comparative perspective. Representing the Department of Justice, SJ delivered a welcoming speech at the opening of the Conference on 28 April 2000, in which she stressed that although we were faced with unique constitutional issues that might not have been encountered elsewhere, the experience from overseas jurisdictions would provide us with a fruitful source of inspiration at the beginning of the journey to develop our own constitutional jurisprudence and, with a positive approach and knowledge gained from other jurisdictions, such issues could undoubtedly be resolved in a satisfactory manner under the principle of "one country, two systems".

In addition, Mr Robert Allcock, Solicitor General (Acting), and Mr Andrew Bruce, SC, Senior Assistant Director of Public Prosecutions, have delivered speeches on the "Application of Article 158 of the Basic Law" and "The Flag Case: A Short Reflection in the Presentation of the Case and Its Significance as a Piece of Constitutional Decision-making" respectively at the Conference.

Solicitor General's Statement at RTHK's Programme

The Acting Solicitor General, Mr Robert Allcock in his statement delivered at RTHK's programme "Viewpoint" on January 30, 2000 assured that the Administration understands and accepts the importance of its constitutional responsibility to explain and defend the fundamental principle of judicial independence.

Law Officer (International Law)

WTO Dispute Settlement - A Hong Kong Perspective from the Law Officer (International Law)

The Law Officer (International Law) gave the Inter-Pacific Bar Association a Hong Kong Perspective on the Dispute Settlement procedures established by the World Trade Organisation. In his presentation he described Hong Kong's supportive role in the activities of the World Trade Organisation and its dispute settlement system, and concluded that, although there were aspects of the system that required enhancement, the first five years of the current arrangements had proved a success.

"Hong Kong Letter" delivered by The Secretary for Justice

The Secretary for Justice spoke on the implementation of the Basic Law in RTHK's "Hong Kong Letter" programme upon the 10th anniversary of the promulgation of the mini-constitution of the HKSAR. She said the preservation of the common law system, and judicial independence, and the constant upholding of the rule of law are all illustrations of its successful implementation.
