If the child in respect of whom you have rights of custody has been abducted and removed from Hong Kong, or you have reasons to suspect that he/she has been abducted and is likely to be removed from Hong Kong, take the following steps -
- report the child as missing to the Hong Kong Police and provide all relevant details about the child and the person suspected of taking the child, including the following (if applicable and available) -
- recent photographs;
- names with aliases or nicknames, sexes, ages, dates of birth and places of birth;
- details of Hong Kong identity cards, birth certificates and travel documents;
- present and previous addresses;
- description, including special features and characteristics;
- any mental/physical incapacity or known medical condition;
- the time and place last seen and description of clothing;
- usual activities and places frequented;
- names and addresses of associates;
- the marriage certificate and divorce decree nisi/absolute of the child's parents, any court order or agreement on custody or access and any other relevant document or correspondence;
- if you are not certain that the child has left Hong Kong, contact the Central Authority of Hong Kong to request for assistance in obtaining information on departure details of the child, or seek legal advice from your Hong Kong lawyer;
- if the child has left Hong Kong and has been taken to a Contracting State or territory having a Convention relationship with Hong Kong, contact the Central Authority of Hong Kong or contact the Central Authority of that Contracting State or territory directly for assistance, or seek legal advice from your Hong Kong lawyer or lawyers in that Contracting State or territory;
- if the child has left Hong Kong and has been taken to a Contracting State or territory that does not have a Convention relationship with Hong Kong or a non-Contracting State or territory, seek legal advice from your Hong Kong lawyer or lawyers in that State or territory.
If you have reasons to suspect that the child in respect of whom you have rights of custody has been removed to or retained in Hong Kong and the child was habitually resident in a Contracting State or territory having a Convention relationship with Hong Kong immediately before the removal or retention, take the following steps -
- report the child as missing to your local police;
- contact the Central Authority of that Contracting State or territory or contact the Central Authority of Hong Kong directly for assistance, or seek legal advice from your local lawyer or Hong Kong lawyers.
